Employer Liability with
Discrimination/Harassment Claims
By Bryan Yingst / July 2007
So, your organization has policies and procedures for
Equal Employment Opportunity in place. But, does your
organization ACTIVELY practice them? If not, your
company may be exposing itself to substantial legal
liabilities should an employee should act out of turn.
Most companies that feel they are adequately “covered”
by adhering to EEOC guidelines and by adopting
anti-discrimination policies on paper. However,
when the time comes, those who do not know better are
shocked to hear that they are liable for their employees
and managers who were never properly trained.
You see, in order for the employer to be free from cases
of discrimination or harassment stemming from one of
their employees, an employer must prove that they
reasonably attempted to prevent and promptly correct the
issue at hand. This includes adequately educating
employees not only on company policies and procedures,
but in some instances, prevention, mediation, and
resolution techniques. Some progressive states have even
adopted mandatory training laws for companies to
increase awareness and to further hold employers liable
for delivering adequate training.
With this said, if your organization has an employee
who...
- might expose your organization to a
discrimination claim
- blames others but won't look in the mirror
- looks down at others who are different from
himself/herself
or
- needs another chance to improve
...now's the time to address the issue and
ensure that your company's best interests are
protected.
We have two training courses that can help.
Our
Diversity and Inclusion e-learning course
was designed to help your employees recognize,
appreciate and utilize the unique insights,
perspectives and backgrounds of others while
avoiding discrimination and disrespectful
behavior.
And, our
Sexual Harassment Prevention e-learning
course is geared to help your team avoid gender
discrimination and sexually disrespectful
behavior.
Each course will satisfy most state laws for
mandatory training.
